Terms & Conditions
- 'The Business' refers to Ambition Sailing or Ambition Solutions Ltd depending on the activity.
- These Terms of Business are applicable to all activities organized by The Business.
- Additional or modified Terms of Business may be applicable for certain activities as stated below.
- The Terms of Business in force at the date of booking will apply (based on date of receipt by the Business of a completed, signed booking form).
- The Businesses are UK based and subject to the exclusive jurisdiction of English law.

Booking Conditions
- A place on your chosen activity will be reserved on receipt of a completed, signed booking form and 30% deposit payment which is non refundable.
- Reserved bookings will become confirmed on receipt of the Balance Payment (total cost less deposit paid) due not less than six weeks before the start date of the activity.
- Non payment may result in the place being re-allocated. In this case all payments except the initial deposit will be refunded.
- It is the responsibility of the Client to ensure that all required passports and visas are available and in date.
- The Business will treat all Client details as confidential and under no circumstances will they be passed on to third parties without the consent of the Client.
Cancellation/Curtailment
- In the event of cancellation by the Client more than six weeks before the published start date of the activity any amounts paid, except the initial deposit, will be refunded.
- In the event of cancellation by the Client within six weeks of the published start date of the activity, the Client will be liable for the full cost of the activity and full payment will be due to / retained by The Business.
- The Business, at their discretion, will consider all individual circumstances resulting in cancellation and if the place can be reallocated, may refund some or all of the Balance Payment or agree a mutually convenient alternative date with the client.
- In the event of the activity being cancelled by The Business, the liability of The Business will be limited to a refund of payments received from the Client, except as referred to in Para 33 below
- If for any reason the activity is curtailed, a prorata refund will be made for each complete 24 hour period of curtailment. If the activity is curtailed by more than 25% of the overall duration, the Business will refund the activity fee paid by Client(s)
- Force Majeure – The Business reserves the right to cancel/curtail the activity due to circumstances amounting to Force Majeure – these include, but are not limited to, war, riots, terrorism, fire, weather conditions, strike action, and all similar events beyond the control of The Business.
Amendments To Bookings
- Date changes requested by the Client more than six weeks prior to the commencement date of the activity will be considered and may be agreed by mutual consent.
- Within six weeks of the commencement date of the activity any date change requested by the Client will be considered to be a cancellation.
- The Client will be liable for any costs specific to an activity that are not recoverable following an amendment to a booking. These include, but are not limited to, function rooms, restaurant hire, accommodation, travel expenses.
Alterations
- The Business website, www.ambitionsailing.com, shall be used as the primary reference for activity descriptions, prices and dates.
- All details given on The Business website are provided in good faith, however The Business reserves the right to change, cancel or curtail any advertised activity should circumstances necessitate it.
- The Business's representatives (eg instructors, skippers) have complete discretion with respect to canceling, curtailing or altering practical boating activities based on current and forecast weather conditions, the practical ability of the client group or the availability of the craft
Safety & Seamanship
- The Client must be in good physical health at the start of your course (if in doubt consult your GP)
- The Client agrees to be a considerate participant and to respect the craft, other clients and neighbouring boat users.
- The Business reserves the right to terminate the Client booking at any time if the Client is in possession of illegal substances or if Client behaviour is considered unacceptable by the Business during the the activity
- The Business reserves the right to temporarily suspend Client involvement in the activity if it is suspected that their judgement is considered by the Business as impaired for any reason such as alcohol consumption.
RYA Course Completion Certification
- The Business will provide all necessary coaching but as with all assessment and training activities cannot guarantee the Client will achieve the standard required for successful completion. The decision of the instructor or assessor is final. For externally moderated exams an RYA appeals process is available.
Own Boat Tuition
- For own boat tuition and delivery, the Client must ensure their craft is fully insured and the insurance company must be informed that an instructor will be on board. The Client will remain the skipper, however the instructor’s decision is final with respect to safety issues.
- The Client is responsible for providing meals, accommodation and travelling expenses for the instructor as well as covering all mooring, fuel and general boat expenses.
Liability
- Sailing, motor cruising and powerboating are dangerous sports. Every effort is made to ensure the Clients' safety. The Business shall have no liability for death, personal injury, loss or damage to personal property, nor any consequential losses resulting from such incidents.
- The Business shall have no liability for refunds, expenses incurred nor consequential losses (eg repatriation, accommodation) as a result of cancellation, curtailment or termination/suspension of Client involvement in the activity by The Business
- The Business reserves the right to cancel an own boat tuition or delivery activity at any time without refund if they or their agents consider the boat to be unfit, unseaworthy or lacks essential equipment for safe navigation and passage making.
- The Business may cancel or curtail the activity without refund as a result of Force Majeure (see above)
Additional Notes - All Activities
Dietary Requirements
The Business will endeavour to satisfy all essential medical dietary requirements stated on the booking form by the Client. However for activities outside the UK this can not be guaranteed.
Insurance
We recommend that you have an appropriate insurance policy in place for the duration of your activity to cover eventualities such as cancellation, illness, injury and repatriation.
Client Feedback
The Business aims to provide the best activities and service and is dedicated to the success and enjoyment of every participant. Feedback and suggestions for improvement help us understand your view of how the activity was implemented and helps us improve our service. We ask all clients to complete a Feedback Form at the end of each activity. Letters and emails are also very welcome (including letters of praise!!).
If you should have a problem or complaint, it is important that you tell the skipper during the activity. They will endeavour to resolve it immediately or refer it to The Business for further attention. In the case of RYA courses, if resolution is not achieved, the Client may choose to refer the issue to the RYA.
Holiday, Regatta & Yacht Racing Activties only
Individuals are afforded the following financial protection when booking on an Ambition Solutions Ltd holiday, regatta or racing activity
International Passenger Protection (IPP)
In accordance with "The Package Travel, Package Holidays and Package Tours Regulations 1992" all passengers booking with Ambition Solutions Ltd are fully protected for the initial deposit and subsequently the balance of all monies paid to us, including repatriation if required, arising from cancellation or curtailment of your travel arrangements due to the insolvency of Ambition Solutions Ltd
There is no requirement for Financial Protection of day trips, and none is provided.
This Insurance has been arranged by International Passenger Protection Limited and underwritten by Insurers who are members of the Association of British Insurers.
Supplementary Terms Of Business - Caribbean Activities
The following Terms of Business are applicable to all Caribbean activities and supplement or modify the Terms Of Business above
Booking Conditions
C1 Reserved bookings will be fully confirmed on receipt of the balance payment due not less than ten weeks before the start date of the activity.
Cancellation
C2 The refund and client payment policy is unchanged however the trigger cancellation deadline is ten weeks prior to the activity start date.
Security Deposits
C3 A security deposit of £375 per person is applicable to all activities and payable with the balance payment. This deposit is fully refundable providing no loss or damage to the yacht/inventory, howsoever caused, occurs during the activity. However if such loss or damage has occurred there will be a commensurate reduction in refund of the security deposit to the Client. The refund of the security deposit will be made when all claims for loss or damaged have been settled by the Business.
